Share housing is a common form of rental housing – about one in 10 households in rental housing is a group of persons who are otherwise not related.
Legal relations in share housing vary considerably: housemates may be co-tenants, or head-tenant and sub-tenant, or head-tenant and lodger. A single share house may contain any or all of these legal relations.
(Note that we do not include in our discussion of ‘share housing’ cases where one of the ‘housemates’ is actually the owner of the premises. In these cases, the owner is always a landlord, and the other housemates are tenants or lodgers.)
